Nashville Judge Finds New DUI Law Unconstitutional
As I predicted in my last blog entry, the new law designed to prevent those charged with repeat offense DUIs from receiving an immediate bail was challenged and found to be unconstitutional. Judge Mark Fishburn ruled that the new law violated the Tennessee Constitution as the Constitution requires that bail be set except for those facing capital offenses.
